These Terms of Service ("Terms") govern your access to and use of the game-server and web-hosting services offered by NecroNet LLC ("NecroHost", "we", "us"). By creating an account or using the services, you agree to these Terms. If you do not agree, do not use the services.
You must provide accurate account information and keep it current. You are responsible for activity under your account and for keeping your credentials secure. You must be old enough to form a binding contract in your jurisdiction. We may refuse, suspend, or close accounts at our discretion, including for violations of these Terms or the Acceptable Use Policy.
NecroHost provides managed hosting of game servers and related web/backend hosting on dedicated single-thread compute. Specifications, game availability, regions, and features are described on the site and may change. We provision, tune, back up, and monitor servers on your behalf; you control the game world, configuration, mods, and content you run within the limits of these Terms and the Acceptable Use Policy.
We offer two billing models, selectable per server:
Prices, rates, and any applicable minimums are shown at the point of purchase. Taxes and fees may apply and are handled as described in Section 4.
Payments are processed by a third-party Merchant of Record ("MoR"), Link, LLC (Stripe). The MoR is the seller of record for your purchase: it handles payment collection, invoicing, and the calculation, collection, and remittance of any applicable sales tax, VAT, GST, or similar taxes. NecroHost does not store or process your full payment-card details. Your purchase is also subject to the MoR's own terms and privacy policy presented at checkout. Where the MoR's terms conflict with these Terms as to payment, tax, and refunds mechanics, the MoR's terms govern those mechanics.
Flat-monthly subscriptions renew automatically at the end of each service period at the then-current price, using your payment method on file with the MoR, until you cancel. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid period unless stated otherwise. Ad-hoc metered servers renew with the applicable monthly base charge ($2.99, or 99¢ while parked), then accrue charges by metered compute time; charges accrue only while a server runs. Cancellation and refund mechanics are described in the Refund & Service Policy.
We aim for high availability and operate on a best-effort basis, with monitoring, tested off-site backups, and hardware burn-in as described on the site. We do not offer a guaranteed uptime service-level agreement (SLA) unless one is separately and expressly agreed in writing. The services are provided without a promised uptime percentage, and scheduled maintenance, provider outages, network conditions, and force-majeure events may interrupt availability. Any optional service credits are described in the Refund & Service Policy.
We may suspend or terminate your access for non-payment, violation of these Terms or the Acceptable Use Policy, legal requirement, or risk to our systems or other customers. You may terminate at any time by cancelling.
Data handling on termination. On cancellation or termination, your server is stopped and your server data and backups are scheduled for deletion after a retention grace period of 3 months (90 days), after which the data is permanently and irretrievably deleted. During the grace period you may request an export or reactivation where technically feasible. We provide standard SFTP and portable server formats so you can retrieve your world before deletion; you are responsible for exporting any data you wish to keep.
Your use of the services is subject to the Acceptable Use Policy, which is incorporated into these Terms by reference. You are responsible for the content, mods, plugins, and game software you run and for holding any licenses those require.
Except as expressly stated, the services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure, or that data will never be lost.
To the maximum extent permitted by law, NecroHost and its owners, members, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or game progress, arising out of or relating to the services, even if advised of the possibility. Our total aggregate liability for any claim relating to the services will not exceed the greater of (a) the amounts you paid to us for the affected service in the three (3) months before the event giving rise to the claim, or (b) US$50. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
We may update these Terms from time to time. Material changes will be posted here with a revised "Last updated" date and, where appropriate, notified by email. Your continued use of the services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Virginia, without regard to its conflict-of-law rules. The parties submit to the courts located in Virginia for disputes not otherwise subject to the Merchant of Record's terms, except where mandatory local law provides otherwise.
